Recital 30 of the General Data Protection Regulation refers to Cookies and their impact on data protection, stating “Natural persons may be associated with online identifiers provided by their devices, applications, tools and protocols, such as internet protocol addresses, cookie identifiers or other identifiers such as radio frequency identification tags. This may leave traces which, in particular when combined with unique identifiers and other information received by the servers, may be used to create profiles of the natural persons and identify them,”, therefore, and in accordance with applicable regulations, Empark Aparcamientos y Servicios, S.A. and its affiliates, (https://www.empark.com/es/es/listado-de-sociedades-del-grupo-empark), (hereinafter “Empark”) has a data policy which complies with the foregoing and applicable regulations 

There are two legal duties imposed by regulations: (i) the duty of transparency, and (ii) the duty to obtain consent. 

(i) With regards to the duty of transparency 

Section two of article 22 of Law 34/2002 dated 11 July regarding information company services and electronic trade (LSSI) establishes that users must be provided with clear and comprehensive information on the use of data recovery and storage devices, specifically regarding data processing purposes. To comply with the foregoing, the following questions must be answered: 

  • What are cookies? 

A cookie is a data packet which a web browser automatically stores on a user’s computer when they visit a web page. The cookie is sent from the server to the web page’s visitor. After that, each time that the user visits the same web page or another on the same domain, the cookie will be read by the web browser, without being modified, and returned to the web server. A cookie is therefore just data which is stored on the user’s computer.

Analysis or measurement cookies: cookies which allow the manager to monitor and analyse the behaviour of users of websites to which they are linked, including measuring advertising impact. The information collected through this type of cookies is used to measure website, application or platform activity, in order to make improvements with regards to analysis of the usage data by service users. 

Behavioural advertising cookies: cookies which store user behavioural information obtained by continuous observation of browsing habits, which allows it to develop a specific profile to show advertising as a result. 

Session cookies: cookies designed to collect and store data whilst the user accesses a web page. They are usually used to store information which is only necessary to provide the service requested by the user on a single occasion (e.g. a list of purchased products) and they disappear when the session ends. 

Persistent cookies: cookies where data continues to be stored on the device and can be accessed and processed for a period defined by the cookies manager, which could range from several minutes to several years

Campaign Manager (Doubleclick) 

Campaign Manager uses cookies to display ads relevant to users, improve campaign performance reports or to prevent a user from seeing the same ads more than once.
